These Terms of Service ("Terms") govern your access to and use of the PulseID software, applications, and website (the "Service") provided by PulseTech ("PulseTech," "we," "us"). By creating an account, installing the apps, or otherwise using the Service, the business and the individuals acting on its behalf ("you," the "Location") agree to these Terms. If you do not agree, do not use the Service.
1. The Service
PulseID lets age-restricted businesses scan the barcode on a government-issued ID to verify a patron's age, help detect forged IDs, and maintain that Location's own list of flagged patrons. The Service includes a mobile scanning app and a web administration dashboard. We may update, improve, or modify the Service over time.
2. Accounts and access
You are responsible for the accounts and credentials issued to your Location, for keeping them confidential, and for all activity that occurs under them. You must promptly disable or rotate credentials for staff who leave. You must provide accurate registration information and keep it current.
3. Your responsibilities and acceptable use
You agree that you will:
- Use the Service only for lawful purposes — verifying age and identity, preventing fraud, and maintaining premises security — and not to harass, discriminate against, or unlawfully profile any person.
- Comply with all laws applicable to scanning, using, retaining, and disposing of ID data in the jurisdictions where you operate, including any requirement to post notice of scanning or to obtain a patron's consent.
- Configure your retention settings and flag practices in good faith and consistent with applicable law, and not attempt to circumvent the compliance controls built into the Service.
- Keep flag, ban, and trespass records accurate, and promptly correct or remove records you know to be wrong.
- Not resell, sublicense, reverse-engineer, scrape, or build a competing service from the Service, and not attempt to access another Location's data.
- Not use the Service to assemble or share a cross-business "banned-patron" database with unrelated businesses.
4. Data and privacy
With respect to data collected from scanned patrons, the Location is the data "controller" and PulseTech is the "processor" acting on the Location's instructions. Our handling of that data is described in the Privacy Policy, which is incorporated into these Terms. You are responsible for the lawfulness of the scanning you direct and for providing patrons any notice or rights required by law. You grant us the limited rights needed to host and process the data to provide the Service.
5. Intellectual property
The Service, including its software, design, and content, is owned by PulseTech and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business operations for as long as these Terms are in effect. All rights not expressly granted are reserved.
6. Fees
Where the Service is offered on a paid basis, fees, billing cycles, and payment terms are those stated in your order or subscription. Unless stated otherwise, fees are non-refundable. We may change fees on prospective notice.
7. Apple App Store purchases and subscriptions
This section applies when you obtain PulseID through the Apple App Store, and it controls over any conflicting term above. PulseID Basic is licensed to an individual user rather than to a Location; for that plan, "you" means that individual.
Products and pricing. The following are offered as in-app purchases:
- PulseID Basic Monthly — auto-renewing subscription, 1-month term, $5.00 per month.
- PulseID Basic Yearly — auto-renewing subscription, 1-year term, $60.00 per year.
- PulseID Basic Lifetime — one-time purchase of $200.00. Not a subscription; it does not renew.
- PulseID Starter — auto-renewing subscription, 1-month term, $79.00 per month, per location.
- PulseID Standard — auto-renewing subscription, 1-month term, $129.00 per month, per location.
Auto-renewal. Payment is charged to your Apple ID account at confirmation of purchase. A subscription renews automatically at the same price for the same term unless auto-renew is turned off at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends. You can manage or cancel a subscription, and turn off auto-renewal, in iOS Settings › your name › Subscriptions. Cancelling stops the next renewal; it does not shorten the period you have already paid for. Where a free trial is offered, any unused portion is forfeited if you purchase a subscription during the trial. Refunds are handled by Apple under the App Store Terms of Service, not by PulseTech.
Terms required by Apple. This agreement is between you and PulseTech only, and not with Apple; PulseTech, not Apple, is solely responsible for PulseID and its content. Your license to use PulseID is a non-transferable licence to use it on any Apple-branded product that you own or control, as permitted by the Usage Rules in the App Store Terms of Service. PulseTech is solely responsible for any maintenance and support, and Apple has no obligation to furnish either. In the event of any failure of PulseID to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to PulseID, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are PulseTech's sole responsibility. PulseTech, not Apple, is responsible for addressing any claim relating to PulseID, including product-liability claims, any claim that PulseID fails to conform to a legal or regulatory requirement, and claims arising under consumer-protection or privacy law. In the event of a third-party claim that PulseID infringes intellectual-property rights, PulseTech, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of that claim. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You must comply with any applicable third-party terms of agreement when using PulseID. Apple and its subsidiaries are third-party beneficiaries of this agreement and, upon your acceptance, will have the right to enforce it against you. 8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PulseID is a tool that assists with age and identity verification; it does not guarantee that every fraudulent, altered, or borrowed ID will be detected, and it is not a substitute for your staff's judgment or for legal advice. You remain solely responsible for your admission, service, and compliance decisions.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSETECH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
10. Indemnification
You will defend, indemnify, and hold harmless PulseTech from claims, losses, and expenses arising out of your use of the Service, your scanning and data practices, your flag/ban/trespass records, or your violation of these Terms or of applicable law.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or its users. On termination, your right to use the Service ends; data handling after termination follows the Privacy Policy and applicable retention law.
12. Changes to these Terms
We may update these Terms as the product and the law evolve. Material changes will be reflected by the "last updated" date above; your continued use of the Service after a change takes effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the United States and the state in which PulseTech is organized, without regard to conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the state and federal courts located there for any dispute not subject to binding arbitration or a small-claims action.
